    Leaking waterproof boots

I bought a pair of waterproof motorbike boots from a well known retailer. I originally bought them in september 2007. In november 2008 I returned them as they were leaking and made my feet wet in the rain, no questions, straight exchange. The new boots are now leaking as well, they are only 11 months old, but the shop is refusing as the original purchase was over 2 years ago. I only see the fact that a 2 year warranty is expired on a pair of 11 months old boots.

    What are my rights?

Try calling them out and say you will get trading standard involved, they will probably brick it and change em for ya. If that fails, follow it through with TS! You must have a case as they are not fit for purpose, unless you are supposed to buy new boots every year?

Once your original warranty has expired you're on your own mate.

The 2 year warranty is on the first pair of boots only, during the warranty period they may replace them as often as required but once the warranty expires your gonna get diddly squat out of them.

Sorry if it's not what you wanted to hear but you did ask.
PS. If you had made a contribution towards the replacement boots of even 1p then you would have had a further 2 years warranty on them.

Is that a sale of goods fact?

Dunno if it's encompassed in the sale of goods literature but it's pretty common practice pretty much across the board.

The guarantee for 2 years was on your original pair of boots not the replacement ones, hence they have decided not to supply you with a new set as your out of the guarantee period.

You could of course take them to the small claims court but I doubt you would win.
